Terms & Conditions
Effective for all estimates, invoices, and service agreements issued by Finch Electrical Heating & Air
1. Payment Terms
Payment is due upon receipt of invoice unless otherwise agreed to in writing. All unpaid balances will accrue a financing charge of 1.00% per month (12% annually) from the date the payment was due until paid in full.
You are responsible for all costs associated with collection of overdue amounts, including attorney’s fees, court costs, bank fees, and any other expenses incurred by Finch Electrical Heating & Air. A service fee will be charged for any returned checks.
All prices are based on conditions known at the time of estimate. Material price increases or additional labor and materials required due to unforeseen conditions discovered after work begins may result in a revised invoice.
2. Credit Card Fees
The customer is responsible for all applicable credit card processing fees at all times, including in situations involving cancellation, refund, or dispute.
3. Scope of Work & Property Representation
The services, terms, and conditions described in the estimate or invoice shall be deemed accepted unless the customer provides written notice of objection within 3 business days of acceptance or completion of services.
By signing or accepting services, the customer represents that they own the property at which work is performed, or that they are authorized to authorize work on that property.
Finch Electrical Heating & Air is not responsible for cosmetic damage that occurs as a necessary result of performing contracted work (e.g., drywall cuts required for wiring, access panels, or equipment installation).
4. Cancellation Policy
The customer has the right to cancel authorized work until midnight on the third business day after the date the agreement was signed. Cancellation must be provided in writing.
The following costs remain the customer’s responsibility upon cancellation:
- Permit fees: Any costs associated with pulling a permit for the project are non-refundable and remain the customer’s sole responsibility.
- Restocking fees: If materials were ordered for the project prior to cancellation, a restocking fee of up to 15% of the cost of those materials may apply.
- Credit card fees: All processing fees related to any payment or refund transaction are the customer’s responsibility.
Prior to cancellation or revocation, the customer has a duty to take reasonable care of any goods or materials delivered to the property. After cancellation, the customer must preserve such goods until Finch Electrical Heating & Air is able to retrieve them within a statutory timeframe.
5. Permits & Code Compliance
Finch Electrical Heating & Air is a licensed electrical and HVAC contractor in the State of Minnesota. All work is performed in accordance with applicable local and state codes, including the Minnesota State Electrical Code, Minnesota Mechanical Code, and all applicable local building ordinances.
Where required by law or local jurisdiction, permits will be obtained prior to commencing work. Permit fees are passed through to the customer and are non-refundable once issued, regardless of whether work is completed or cancelled.
All electrical work is performed by or under the direct supervision of a licensed Minnesota Electrical Contractor. HVAC work is performed by or under the supervision of licensed HVAC technicians as required by Minnesota law.
6. Inspections, Re-Inspections & Change Orders
The agreed price covers the scope of work described in the estimate or invoice only. Permitted work is subject to inspection by the applicable municipal authority. The following terms apply to any inspection-related matters:
- Failed Inspections & Re-Inspection Fees: If a required inspection results in a correction notice or fails for any reason, any re-inspection fee charged by the municipality is the customer’s responsibility, provided the failure is not due to a defect in Finch Electrical Heating & Air’s own workmanship.
- Inspector-Required Work Beyond Original Scope: If an inspector requires corrections or upgrades to conditions that were not part of the original agreed scope — including pre-existing deficiencies, concealed conditions uncovered during the project, or code upgrades required by the inspecting authority — such additional work is not included in the original contract price and will be quoted separately.
- Change Order Requirement: All additional work identified during or as a result of inspection must be approved by the customer in writing via a signed change order before Finch Electrical Heating & Air proceeds. The original contract price will be adjusted to reflect any approved change orders.
- Pre-Existing & Concealed Conditions: Finch Electrical Heating & Air is not responsible for costs associated with correcting pre-existing code violations, unsafe conditions, or deficiencies discovered during the course of work that were not visible or known at the time of estimate. Such conditions will be brought to the customer’s attention promptly and a change order will be required before additional work is performed.
7. Lifetime Craftsmanship Warranty

Coverage includes:

9. Insurance & Liability
Finch Electrical Heating & Air maintains general liability insurance and workers’ compensation coverage as required by the State of Minnesota. Certificates of insurance are available upon written request.
Our liability for any claim arising out of services performed is limited to the total amount paid by the customer for the specific work in dispute. We are not responsible for pre-existing conditions, deficiencies in the existing structure, or issues caused by third parties.
10. Dispute Resolution & Governing Law
Any dispute arising out of or related to services provided by Finch Electrical Heating & Air shall be governed by the laws of the State of Minnesota. The parties agree to first attempt to resolve any dispute in good faith through direct communication.
If the dispute cannot be resolved informally, the parties agree to submit to binding arbitration in Hennepin County, Minnesota, in accordance with applicable arbitration rules, before pursuing litigation.
In the event Finch Electrical Heating & Air must pursue collection of any unpaid balance, the customer agrees to pay all reasonable attorney’s fees, court costs, and collection expenses incurred. Each party otherwise bears its own attorney’s fees and costs in any other dispute.
11. Customer Privacy
Finch Electrical Heating & Air collects customer information (name, address, contact details, and service history) solely for the purpose of providing services, sending invoices, and communicating about work performed. We do not sell or share customer information with third parties except as required to complete services (e.g., permit agencies, supply vendors) or as required by law.
12. Pre-Lien Notice — Required by Minnesota Law
WE ARE REQUIRED BY LAW TO GIVE YOU THIS NOTICE. YOU ARE THEREFORE HEREBY NOTIFIED THAT:
ANY PERSON OR COMPANY SUPPLYING LABOR OR MATERIALS FOR THIS IMPROVEMENT TO YOUR PROPERTY MAY FILE A LIEN AGAINST YOUR PROPERTY IF THAT PERSON OR COMPANY IS NOT PAID FOR THE CONTRIBUTIONS.
UNDER MINNESOTA LAW, YOU HAVE THE RIGHT TO PAY PERSONS WHO SUPPLIED LABOR OR MATERIALS FOR THIS IMPROVEMENT DIRECTLY AND DEDUCT THIS AMOUNT FROM OUR CONTRACT PRICE, OR WITHHOLD THE AMOUNTS DUE THEM FROM US UNTIL 120 DAYS AFTER COMPLETION OF THE IMPROVEMENT UNLESS WE GIVE YOU A LIEN WAIVER SIGNED BY PERSONS WHO SUPPLIED ANY LABOR OR MATERIAL FOR THE IMPROVEMENT AND WHO GAVE YOU TIMELY NOTICE.
13. General Provisions
- Entire Agreement: This document, together with the estimate or invoice to which it is attached, constitutes the entire agreement between the parties with respect to the work described and supersedes all prior representations or discussions.
- Severability: If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
- Waiver: Failure by Finch Electrical Heating & Air to enforce any provision of these terms shall not constitute a waiver of the right to enforce that provision in the future.
- Modifications: These terms may be updated from time to time. The version in effect at the time of service shall govern.
- Force Majeure: Finch Electrical Heating & Air shall not be liable for delays or failure to perform due to circumstances beyond our reasonable control, including acts of God, material shortages, labor disputes, or governmental actions.
